Terms of Service

These Terms of Service ("Terms") govern your use of the My Fuel Dock service operated by Navigator PNW LLC ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.
1. The Service
My Fuel Dock provides marina operators with an embeddable price board to display fuel prices on their websites, along with tools to manage prices, hours, and other marina information.
2. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You may not create accounts for marinas you do not own or operate without their authorization.
- One marina per account. Multiple user accounts may be associated with the same marina.
3. Service Tiers
My Fuel Dock operates on four tiers:
- Free. Open to any marina at no charge, with no credit card required, and available indefinitely. Includes a basic price board, limited daily price updates, and a non-removable "Powered by myfueldock.com" attribution.
- Trial. Automatically applied to every new account for 30 days from registration, at no charge. Includes most Paid tier features for internal use, but the public-facing price board is limited to the basic template. If you do not subscribe to the Paid tier before the trial ends, your account converts to Free automatically. See Section 4 for billing terms.
- Charter. A permanent, complimentary tier we may offer at our discretion to selected early-adopter marinas. Includes the same features as the Paid tier, except for the ability to remove or replace the "Powered by myfueldock.com" attribution. Charter status may be revoked with notice if the account becomes inactive or violates these Terms.
- Paid. Available by paid subscription, monthly or annual. Includes all Charter features, plus the ability to remove or replace the "Powered by myfueldock.com" attribution and access to all future Paid tier features. See Section 4 for billing terms.
We reserve the right to modify tier features with reasonable notice. Free tier features will not be moved to a paid tier without 90 days' advance notice.
4. Subscriptions and Billing
The Paid tier is offered as a monthly or annual subscription, charged according to our published prices at the time of subscription. Prices may change with notice; existing subscriptions continue at their current price until the next renewal.
Payment processing. Card payments are processed by Stripe, our payment processor. By subscribing, you authorize us to charge your payment method for the plan you select. We do not store or have access to your full card number, Stripe handles all card data.
Free trial. New accounts include a 30-day trial of Paid tier features at no charge. No payment method is required during the trial. If you do not subscribe before the trial ends, your account automatically converts to the Free tier with no further action required. If you choose to subscribe during the trial, your subscription begins immediately and your card is charged at that time.
Auto-renewal. Card subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel. By subscribing, you consent to this recurring billing.
Cancellation. You may cancel your subscription at any time through the billing portal linked from your Account page. Cancellation takes effect at the end of your current billing period, you keep Paid tier access through that date, after which your account reverts to the Free tier. We do not provide partial refunds for unused time.
Failed payments. If a renewal payment fails, Stripe will retry your card for several days. If payment cannot be collected, your subscription is canceled and your account reverts to the Free tier. You may resubscribe at any time.
Refunds. Refund requests can be sent to contact@myfueldock.com. Refunds are not guaranteed but will be considered in good faith on a case-by-case basis (for example, accidental renewals reported promptly). Any refund issued will revert the account to the Free tier.
Pay by check. Annual subscriptions may be paid by check. You can generate a printable invoice from the upgrade page and mail a check to Navigator PNW LLC at the address shown on the invoice. Your account will activate as Paid for one year within five business days of our receipt of the check.
Taxes. You are responsible for any sales, use, or value-added taxes applicable to your subscription. Where we are required to collect sales tax, the applicable amount will be added to your subscription price at checkout.
Plan changes. You may switch between monthly and annual plans through the billing portal. Plan changes take effect on the next billing period unless otherwise indicated.
Billing disputes. If you have a billing question or concern, please contact us at contact@myfueldock.com before disputing a charge with your card issuer. Chargebacks initiated without first contacting us may result in suspension or termination of your account.
5. Acceptable Use
You agree not to:
- Display inaccurate fuel prices intentionally
- Use the service for any unlawful purpose
- Attempt to access other users' accounts or data
- Interfere with or disrupt the service
- Scrape, crawl, or automatically extract data from the service
- Remove or obscure the "Powered by myfueldock.com" attribution unless your tier permits it
6. Your Data
You own the data you enter into My Fuel Dock. By using the service, you grant us a license to display your fuel prices, hours, and other marina information publicly via the price board, because that is the purpose of the service.
You may export or delete your data at any time by contacting us.
7. Marina Content and Accuracy
You are responsible for the accuracy of all information you submit to My Fuel Dock, fuel prices, hours of operation, fuel availability, payment methods, marina details, and any other content you enter. Once submitted, this information may be displayed:
- On the price board embedded on your marina's website
- In the consumer Fuel Docks mobile app, where boaters use it to plan trips and choose fueling stops
- In any other channel where Navigator PNW LLC publishes marina pricing data
We transmit your information substantially as you enter it and do not independently verify accuracy. We are not liable for losses, damages, or disputes arising from inaccurate, outdated, or incorrect information you submit, including disputes with your customers based on prices or other content you posted. You agree to keep your information current and to correct errors promptly when you discover them.
8. Price Board Embed Code
The embed code we provide loads content from our servers. We reserve the right to modify the appearance, functionality, and behavior of the price board to improve the service. We will not insert advertising into the price board.
9. Mobile App License
When you install the My Fuel Dock mobile app, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, solely for managing the marina account(s) you are authorized to manage. You may not:
- Copy, modify, or create derivative works of the app
- Reverse engineer, decompile, or disassemble the app
- Remove or alter copyright, trademark, or proprietary notices
- Sublicense, rent, lease, sell, or distribute the app
- Use the app for any marina you are not authorized to manage
The app may update automatically through the Apple App Store or Google Play. We may release new versions, change features, or discontinue the app at any time.
App store terms. If you downloaded the app from the Apple App Store, you acknowledge that this license is between you and Navigator PNW LLC, not Apple. Apple is not responsible for the app or its content, has no maintenance or support obligations, and makes no warranty about the app. Apple is a third-party beneficiary of this license and may enforce it against you. The same principles apply to Google and Google Play if you downloaded the app there.
This license terminates automatically if you violate these Terms or close your account. On termination, you must stop using and delete the app.
10. Third-Party Services
My Fuel Dock relies on third-party providers to deliver portions of the service. Your use of My Fuel Dock may involve interaction with:
- Xano — backend database and API hosting
- Cloudflare — web hosting, DNS, and content delivery for the portal and price boards
- Stripe — payment processing for paid subscriptions
- Mailgun — outbound and inbound email delivery (verification, password reset, billing notices, price reminders, support correspondence)
- Twilio — SMS messaging delivery for two-way text-based price updates and service notifications
- Google — Geocoding API for converting marina addresses to map coordinates
- PostHog — product analytics for the portal and mobile app
- Apple App Store and Google Play — distribution and updates for the My Fuel Dock mobile app
- Anthropic — AI parsing of inbound text messages submitted to the SMS price-update service
Use of these services is governed by their respective terms and privacy policies, which you should review. We may add, replace, or discontinue third-party providers at any time. The current list of providers is also reflected in our Privacy Policy.
11. Communications
By creating an account, you consent to receive transactional emails relating to your account, including verification, password reset, billing notices, security alerts, and service announcements. These emails are not promotional and you cannot opt out of them while your account is active.
If you provide a mobile phone number and complete our verification process, you may opt in to receive service-related text messages from My Fuel Dock. These messages include verification codes, price update confirmations, clarifying questions when an update is ambiguous, and operational alerts. We do not use SMS for marketing or promotional purposes. Mobile information and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes. Message frequency varies based on how often you submit price updates and on operational events affecting your account. Message and data rates may apply, depending on your mobile carrier plan. You may opt out at any time by replying STOP to any message; reply HELP for help, or contact us at contact@myfueldock.com. Opting out of text messages does not close your account or affect transactional email.
Marketing emails, if any, will only be sent if you opt in separately, and you can unsubscribe at any time using the link in those emails. We will not sell or rent your contact information.
12. Availability
We strive for high availability but do not guarantee uninterrupted service. We are not liable for temporary outages, scheduled maintenance, or events outside our reasonable control, including internet or hosting provider outages, acts of God, natural disasters, severe weather, labor disputes, government actions, war, civil unrest, or failures of third-party services.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVIGATOR PNW LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THE INFORMATION DISPLAYED THROUGH THE SERVICE IS ACCURATE OR CURRENT.
14. Limitation of Liability
To the maximum extent permitted by law, Navigator PNW LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless Navigator PNW LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Information or content you submit to the service, including fuel prices, hours, and other marina details
- Your violation of these Terms
- Your violation of any law or third-party right
- Your use of the service, including disputes with your customers based on information you posted
We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
16. Termination
You may close your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms, with notice when practical.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the portal at least 30 days in advance. Continued use after the effective date constitutes acceptance.
18. Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles.
19. General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Navigator PNW LLC regarding the service and supersede any prior agreements or understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms without our written consent; we may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets. Section headings are for convenience only and have no legal effect.
